Three UDRP Cases Highlight High Bar for Proving Bad Faith in Domain Disputes

Recent UDRP decisions show panels are holding complainants to strict standards on bad faith, denying cases where domains predate trademarks or have plausible legitimate uses.

Three recent UDRP decisions from the World Intellectual Property Organization illustrate the difficulty trademark holders face in proving bad faith registration and use of domain names. In separate rulings, panels denied complaints against ReelLifeClothing.com, DMSL.com, and Glide.ai, with two of the cases resulting in findings of Reverse Domain Name Hijacking (RDNH).

In the ReelLifeClothing.com case, Outdoor Nation, LLC filed a complaint against a Moroccan respondent who registered the domain in March 2025. The Florida company owns REEL LIFE trademarks for apparel dating back to 2011 and 2018. The panel found the respondent’s fishing-themed clothing site overlapped with the complainant’s goods, defeating rights or legitimate interests, but ruled that bad faith was not proven. The respondent argued he chose “Reel Life” from widespread social media use of the phrase, and the panel found that explanation plausible, noting the complainant had not shown REEL LIFE was famous enough to infer targeting.

DMSL.com and Glide.ai: Domains Predate Trademarks

Two other cases ended in RDNH findings. Deepak Mining Solutions Limited, an Indian company incorporated in 2008, filed a UDRP against DMSL.com, a four-letter .com registered in July 1996. The complainant acknowledged the domain predated its existence by 12 years and only filed trademark applications in 2025. The panel found the complaint was brought in bad faith, as the domain was clearly registered long before any trademark rights existed.

The DMSL.com and Glide.ai rulings send a strong signal that filing disputes against domains that predate trademark rights risks an RDNH finding, which can damage a complainant’s credibility in future disputes.

Domain investors and trademark holders should note that the UDRP requires proof of both registration and use in bad faith. Panels are increasingly scrutinizing complaints for overreach, particularly when the domain has a dictionary meaning or was registered before the trademark existed. As these cases show, a failed UDRP can be costly, not just in legal fees but in reputational harm from an RDNH finding.
