New York Becomes First US State to Impose One-Year Moratorium on Hyperscale Data Centers

New York Governor Kathy Hochul signed a one-year moratorium on July 14, 2026, blocking new environmental permits for hyperscale data centers with a capacity of 50 megawatts or more. The measure makes New York the first US state to impose a statewide pause on data center construction.

The moratorium immediately halts permits for projects meeting the 50MW threshold, a move driven by growing concerns over rising utility bills, water consumption, and strain on local communities. The governor's office stated the pause is needed to develop a regulatory framework before approving further large-scale facilities.

Moratorium Targets Hyperscale Facilities Above 50MW Capacity

The order directs state agencies to conduct a Generic Environmental Impact Statement that will assess energy demand, water use and quality, and air quality impacts from data centers. Within 60 days, the state must provide guidance for local governments to negotiate community benefit agreements with developers.

Lawmakers in Virginia, Minnesota, New Hampshire, Vermont, Oklahoma, Maryland, Georgia, Pennsylvania, South Carolina, Wisconsin, and Michigan have introduced bills calling for state-level bans on new data centers.

At the federal level, Senators Bernie Sanders and Alexandria Ocasio-Cortez introduced the Artificial Intelligence Data Center Moratorium Act in March 2026, which would halt construction nationwide until the government enacts protections for workers, consumers, the environment, and civil rights. The New York moratorium sets a precedent that could accelerate regulatory scrutiny in other states as data center demand continues to surge alongside AI workloads.
